1. Agreement to Terms & Age Eligibility

By accessing Paintfy.art, uploading photos, or placing an order through our platform, you agree to be bound by these Terms of Service. If you do not agree with any portion of these terms, please do not use our services.

Age Requirement (COPPA Compliance): You must be at least 18 years of age (or have the direct consent and supervision of a parent or legal guardian) to upload photos, place orders, or enter into binding agreements on Paintfy.art. Our services are not directed to children under 13, and we do not knowingly solicit or collect personal information from individuals under 13.

2. Description of Service & Products

Paintfy provides bespoke digital artwork synthesis and print-on-demand fulfillment. Our proprietary optical workflows transform customer-submitted photographs into classical, museum-style paintings with the subject's likeness subtly embedded into the brushstrokes and textures.

  • Digital Masterpiece: A high-resolution, print-ready image file (JPG/PNG, up to 4000px+, 300 DPI) hosted in a secure, private web gallery with personal reproduction rights.
  • Giclée Canvas Prints: Museum-grade archival cotton-blend canvas, stretched over solid pinewood stretcher bars (1.25" / 38mm depth), ready to hang with pre-installed mounting hardware.
  • Framed Upgrades: Stretched canvas surrounded by a solid wood floating frame in satin black.

Note: Artworks are created using modern digital synthesis and high-precision giclée printing; they are not wet physical oil paint on canvas applied manually with animal hair brushes.

3. User Content & Image Rights

When you upload an image to Paintfy, you represent and warrant that:

  • You are the creator and copyright owner of the photo, or you have explicit permission from the copyright holder and individuals depicted to use the image.
  • The image does not infringe upon any third-party intellectual property, privacy, or publicity rights.
  • The image does not contain unlawful, harassing, defamatory, or obscene material. We reserve the right to decline processing any image that violates community safety standards.

You retain 100% ownership of your original uploaded photos. You grant Paintfy a non-exclusive, limited license solely to process and render the image for the purpose of fulfilling your artwork order.

4. DMCA Safe Harbor Notice & Copyright Policy

Paintfy respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512). Because our platform processes user-submitted imagery, we maintain a designated copyright agent to respond expeditiously to notices of alleged infringement.

If you believe that any image or content hosted or processed through Paintfy infringes upon a copyright that you own or control, please submit a formal DMCA Takedown Notice to our Designated Agent containing:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the copyrighted work.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material claimed to be infringing, with sufficient detail (URL or Order ID) for us to locate it.
  • Your contact information (name, physical address, telephone number, and email address).
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

5. Personal Use License for Delivered Art

Upon delivery, Paintfy grants you a perpetual, worldwide, non-transferable, non-exclusive license to use the final rendered artwork for personal, non-commercial purposes.

You are free to print the artwork on any personal medium, display it in your home or office, gift physical prints to family and friends, or share it on personal social media accounts. You may not resell the artwork, license it as stock imagery, or mint it as an NFT without express commercial authorization from Paintfy.art.

6. Pricing, Digital Credit & Upgrades

All prices are listed in USD (or local currency as displayed during checkout).

The Canvas Upgrade Guarantee: If you purchase a digital artwork first, the exact amount paid for the digital edition is credited toward any canvas print order placed from your gallery within 90 days. You only ever pay the difference.

7. 100% Likeness Guarantee & Refunds

Because each artwork is uniquely made to order, standard return policies for off-the-shelf consumer goods do not apply. However, we offer our comprehensive 100% Likeness Guarantee:

If your finished artwork does not satisfactorily reflect the likeness of your subject when viewed from a distance or squinted at, our studio team will gladly regenerate and repaint the piece using alternative lighting parameters at zero cost, or issue a full refund in accordance with our Refund & Guarantee Policy.

8. Limitation of Liability

Paintfy.art and its operators shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. In no event shall our total aggregate liability exceed the total amount paid by you for the specific order in dispute.
